Gus H. Small is a senior partner at Small Herrin, LLP.  Gus has represented Debtors, Creditors and Equity Security Holders in Chapter 7 and Chapter 11 cases and has been legal counsel to a number of creditors' committees.  He has also served as a Trustee in Chapter 7 and Chapter 11 cases.

 

Besides serving as legal counsel in bankruptcy cases, Gus specializes in commercial litigation, including jury trials in federal and state court.  He has appeared as counsel in state and federal court in matters involving lender liability, voidable transfers, secured and unsecured creditors' rights, contract disputes, insurance defense cases involving real estate issues, construction lien law and receivership cases.  He has also represented clients in numerous mediations and arbitrations and has served as a mediator and special master. 

 

Gus is admitted to practice before the State Bar of Georgia, the Georgia Court of Appeals, the Supreme Court of Georgia, all federal courts in Georgia, the United States Courts of Appeal for the 4th, 5th and 11th Circuits and the United States Supreme Court.  He is a frequent lecturer on Bankruptcy and Commercial Law, and is the author of The Bank is Not Your Friend, a guide for  small business owners, entrepreneurs, accountants and others not experienced in commercial law and bankruptcy.  The book explains the creditor’s rights and debtor relief system and educates the reader in how the commercial law and bankruptcy system works when a small business suffers financial difficulties.

 

Gus is a graduate of Emory University College and the Walter F. George School of Law at Mercer University.  Prior to coming to Atlanta to practice law, Gus served on active duty as a First Lieutenant in the United States Army in Viet Nam.
